1 Ley de Servicios de la Sociedad de la Información y Comercio Electrónico (Law on Information Society Services and Electronic Commerce)
In compliance with the provisions of art. 10 of Law 34/2002 of 11 July 2002 on Information Society Services (L.S.S.I.), the following General Information is hereby published:
That the domain www.proguias.es, from now the Website, is registered in the name of ALBA RODRÍGUEZ SILGO, (commercially known as PROGUÍAS) with registered address Rúa do Rego, 6C, 5ºD, 15895, O Milladoiro (Ames) and holder of Tax Identification Code 53190510C, from now on THE OWNER.
2 Conditions of use
I. Users
Access to and/or use of the website www.proguias.es confers on the user the status of user, accepting, from that very moment, fully and without reservation, these general conditions, as well as the specific conditions which, where applicable, complement, modify or replace the general conditions in relation to certain services and contents of the website.
II. Use of the Website, its services and contents
The user undertakes to use the Website and its services and contents without contravening current legislation, good faith, generally accepted uses and public order.
Likewise, it is forbidden to use the Website for illicit or harmful purposes against THE OWNER or any third party, or which, in any way, may cause damage or impede the normal operation of the Website.
This website, including but not limited to, editing, compilation, design, text and/or graphics, are the property of the person responsible for the website, and are protected by national and international regulations on intellectual and industrial property. Access by the user to the website does not grant him/her any property right over the same.
Industrial and Intellectual Property rights may not be used without the express consent of their owner, who reserves the right to take appropriate action in the event of infringement of the same, which may constitute a crime under the Criminal Code or result in compensation for damages suffered by the owner in the civil sphere.
In order to preserve the possible intellectual property rights, in the case that any user or third party considers that there has been a violation of their legitimate rights due to the introduction of a certain content in the web, they should notify PROGUIAS of this circumstance, indicating: Personal details of the interested party owner of the allegedly infringed rights.
If the claim is presented by a third party other than the interested party, he/she must indicate the representation with which he/she is acting. Indication of the contents protected by intellectual property rights and their location on the website. Proof of the aforementioned intellectual property rights. Express declaration in which the interested party accepts responsibility for the veracity of the information provided in the notification. The legitimacy of the intellectual or industrial property rights corresponding to the contents provided by third parties is the exclusive responsibility of the same.
III. Unilateral modification
THE OWNER may unilaterally modify the structure and design of the Website, as well as modify or eliminate the services, content and conditions of access and/or use thereof, whenever it deems appropriate, without prior notice.
IV. Hyperlinks
The establishment of any "hyperlink" between a web page and the Website shall be subject to the following conditions:
No reproduction, in whole or in part, of any of the services or contents of the Website is permitted.
Except with prior express consent, the website on which the hyperlink is established shall not contain any trademark, trade name, business name, establishment sign, denomination, logo, slogan or other distinctive signs belonging to the OWNER.
Under no circumstances shall THE OWNER be responsible for the content or services made available to the public on the website from which the hyperlink is made, nor for the information and statements included therein.
V. Disclaimer of warranties and liability
THE OWNER does not grant any guarantee and shall not be liable, in any case, for damages of any nature that may be caused by:
- The lack of availability, maintenance and effective functioning of the Website and/or its services or contents.
- The lack of usefulness, suitability or validity of the Website and/or its services or contents to satisfy the needs, activities or specific results or expectations of users.
- The existence of viruses, malicious or harmful programmes in the contents.
- The reception, collection, storage, dissemination or transmission of content by users.
- The illicit, negligent, fraudulent use, contrary to these General Conditions, to good faith, to generally accepted uses or to public order, of the Website, its services or contents, on the part of the users.
- The lack of legality, quality, reliability, usefulness and availability of the services provided by third parties and made available to users on the Website.
- The non-fulfilment by third parties of their obligations or commitments in relation to the services provided to users through the Website.
VI. Duration
The duration of the provision of the Website and its services is indefinite.
Notwithstanding the foregoing, THE OWNER reserves the right to interrupt, suspend or terminate the provision of the Website service or any of the services comprising it, under the same terms as set out in the third condition.
The structure and design of the website may be modified unilaterally and without prior notice, whenever deemed appropriate, as well as modifying or eliminating the services, contents and conditions of access and/or use of the website.
VII. Applicable law and jurisdiction
These General Conditions shall be governed by Spanish law.
PROGUIAS and the user agree to submit to the jurisdiction of the corresponding Courts and Tribunals for any questions that may arise or actions that may be exercised derived from the provision of the service of the website and its services and contents and about the interpretation, application, fulfilment or non-fulfilment of what is established here.
In the event that the User is domiciled outside Spain, PROGUIAS and the User, expressly waiving any other jurisdiction that may correspond to them, submit to the Jurisdiction of the Courts and Tribunals of Santiago de Compostela, except in those cases in which the jurisdiction corresponds to the domicile of the user.
